In Thailand, car and motorcycle rental is a contract service. The renter gets a named vehicle for a set time. The renter, or another approved driver, drives it. This is not the same as a taxi or a car with a hired driver.
OCPB now gives this service a clear contract frame. Its 2025 rule took effect on 30 December 2025. The rule covers cars and motorcycles. OCPB says the standard contract must name the vehicle. It must also state the rental term, handover, return, payment, each side's duties, and replacement terms. OCPB linked the rule to complaints about lost deposits, unfair contract endings, and missing replacement cars.
The driving licence is a separate issue. TAT says a driver in Thailand needs a valid driving credential. It lists a Thai licence, a valid IDP under an accepted pact, or an ASEAN domestic licence. TAT also says a person who rents a car or motorbike must show a valid licence or IDP. A DLT-sourced state page says a foreign licence used for a Thai temporary licence must be for the same vehicle type.
Roads, licences, and service
Insurance is another layer. OIC separates compulsory cover from voluntary motor cover. The compulsory scheme is mainly about harm to people in road crashes. It is not the same as cover for damage to the rented car. A rental firm can also use a damage waiver. Budget Thailand says its LDW can cut the renter's loss to an excess, subject to the rental contract. It also says some banned uses can void the waiver.
A deposit is contract security. It is not insurance. OCPB's rules are the best source for how a deposit fits the rental deal. Fixed deposit sums should not be treated as lasting facts.
Vehicle condition also matters at handover. TAT says renters should check roadworthiness, registration, and insurance. Common fleet types include small cars, sedans, SUVs, vans, pickups, and some electric or hybrid cars. Exact models can change.
